Rollover Policy

1. Definitions

• 1.1. "Credits" are usage units that allow exporting videos on Editlabs (e.g., 100 credits ≈ 60s of video)
• 1.2. "Cycle" is the plan's billing period (monthly/annual, accounted for month-to-month)
• 1.3. "Paid Plan" refers to Starter, Pro, Premium, and Team plans. "Freemium" refers to the free plan

2. Validity and Rollover

• 2.1. Credits granted in each cycle are valid for 60 (sixty) days from the date/time of grant
• 2.2. Unused credits within the cycle automatically roll over to the next cycle, subject to the cap in item 3

3. Accumulated Balance Cap

• 3.1. At the beginning of each cycle, the user's total balance on Paid Plans may not exceed the equivalent of 2 (two) times the monthly allowance of the current plan
• 3.2. If the balance exceeds the cap, the oldest credits expire until the balance returns to the limit

4. Consumption Order (FIFO)

• 4.1. Credits are consumed on a "first in, first out" (FIFO) basis, always prioritizing the oldest ones (and those with the closest expiration)

5. Eligibility

• 5.1. Rollover applies only to Paid Plans
• 5.2. Freemium: credits do not accumulate and expire at the end of the cycle/validity period defined for the free plan

6. Plan Changes

• 6.1. Upgrade (to a higher plan): existing credits remain valid and will follow the new plan's cap
• 6.2. Downgrade (to a lower plan): at the start of the cycle, the balance is limited to the new plan's cap; excess and oldest credits expire
• 6.3. Plan changes may adjust the allowance for the subsequent cycle; cap validation considers the allowance in force at the start of each cycle

7. Top-ups (One-off Credits)

• 7.1. Credits acquired via top-up are valid for 90 (ninety) days from purchase
• 7.2. Top-ups are consumed via FIFO together with other credits
• 7.3. Top-ups are non-refundable and non-convertible to cash

8. Cancellation, Termination, and Default

• 8.1. If the plan is canceled, credits expire at the end of the already paid period
• 8.2. In case of interruption due to default, access to the balance may be suspended, and credits may expire during the suspension, according to validity periods
• 8.3. There is no compensation or refund for unused credits

9. Limitations and Anti-Abuse

• 9.1. Credits are non-transferable between accounts and have no cash value
• 9.2. Editlabs may limit functionality or throughput (e.g., queue/priority) in accounts with anomalous or abusive behavior
• 9.3. Systemic adjustments (e.g., codec, bitrate, or maximum duration changes) may occur to ensure operational stability, and validity periods continue to apply

10. Time Reference

• 10.1. Dates/times consider the time zone configured in the user's account profile. If not configured, the default Editlabs time zone applies

11.1. Starter Plan Example

Starter (3,000 cr/month): if you use 1,800 cr in month 1, 1,200 cr remain and roll over to month 2. At the start of month 2, your maximum limit is 6,000 cr (2x the allowance). If you already had 5,200 cr and received another 3,000 cr, you would exceed 6,000; thus, the 2,200 oldest cr would expire, and you would be left with 6,000.

11.2. Downgrade Example

Downgrade from Pro (6,000 cr) to Starter (3,000 cr): at the start of the next cycle, the maximum allowed balance becomes 6,000 cr (2x the new plan). The excess above this value expires, starting with the oldest credits.

3. Does Editlabs' AI train with my data?

By default, no. Using data for model improvement is opt-in in the settings/Privacy Policy.

Integrations & Publishing

1. Can I publish directly to TikTok/Instagram/YouTube?

We offer integrations where allowed by the platforms and account type. Restrictions and approvals may vary.

2. Does it integrate with Google Drive / cloud?

Yes, for upload/backup when enabled on the plan.

3. How do costs for third-party APIs work (e.g., AI, captions)?

Generally, usage in production is included in your plan/consumption. Overage/extra services may incur additional costs; everything is shown before confirming.

Privacy, Security & Compliance

1. Do you follow LGPD/GDPR?

2. How does Editlabs protect my files?

You. Editlabs does not claim ownership over your outputs (see the Terms).

4. What can't I do on the platform?

Illegal, infringing, discriminatory, violent, sexually explicit content or content that violates destination platform policies is prohibited. Accounts may be suspended in case of abuse.

1. How do I talk to support?

Distance Sales Agreement

3. Pre-contractual Information and Contract Formation

• 3.1. Before contracting, we publish: total price (with taxes/fees where applicable), main characteristics, payment conditions, duration, cancellation/refund policy, and contact details
• 3.2. The contract is formed when you (i) create an account, (ii) accept this Agreement, the Terms of Use, and the Privacy Policy, and (iii) Editlabs confirms the contracting by electronic means
• 3.3. You declare you have the capacity to contract; if acting for a company, you declare having powers of representation

4. Description of Services and Digital Delivery

• 4.1. The Services consist of online access to video editing functionalities (including AI features) executed in a web environment, with no delivery of physical media
• 4.2. Availability is immediate after confirmation of contracting, except for technical necessity or anti-fraud verification
• 4.3. Performance may depend on external factors (network, device, third-party integrations). Scheduled maintenance will be communicated with reasonable advance notice; emergencies may occur without prior notice, with subsequent communication

5. Plans, Prices, Billing, and Taxes

• 5.1. Prices and features of each Plan are available at https://editlabs.ai/pricing
• 5.2. Subscriptions are recurring (auto-renewal) until canceled by the user
• 5.3. Charges are processed by Stripe and Coinbase; taxes/fees may be added according to applicable legislation
• 5.4. Where required, we issue an electronic invoice/receipt

6. Renewal, Upgrades, and Subscription Cancellation

• 6.1. You can cancel at any time via the account dashboard; access remains until the end of the current cycle
• 6.2. Upgrades/downgrades may adjust price/limits from the next cycle (or immediately, when indicated)
• 6.3. Purchases via App Store or Google Play follow the respective stores' billing and cancellation policies

7. Cancellation and Refunds — Global Policy (Digital Content/SaaS)

1. Recurring Cancellation (global)

You can cancel at any time via the account dashboard. Access remains until the end of the current cycle. There is no pro-rata refund for the current cycle, unless local law requires otherwise.

2. Legal rights of withdrawal/regret (consumers)

• European Union/EEA/UK (14 days): For distance contracts, the consumer can withdraw within 14 days. For digital content not supplied on a physical medium, the right does not apply if performance begins with your express consent and your acknowledgment that you will lose the right of withdrawal before it begins. We provide instructions and the model form. Refund within 14 days after valid notification
• Turkey (14 days): Right of withdrawal within 14 days for distance contracts; refund within 14 days after valid notification; similar exceptions for digital content executed with consent, according to local regulation
• Brazil (7 days): Right of regret within 7 days from contracting; immediate refund of amounts paid. The request can be made via the dashboard and by email (support@editlabs.ai)

3. Accepted channels for withdrawal/regret

We accept requests via the dashboard and by email (support@editlabs.ai). We also accept any unequivocal statement sent within the applicable legal period.

4. Refund deadlines (when due)

We will initiate the refund within 14 days of your valid notification (immediate in Brazil, where applicable). The credit on the invoice depends on the card issuer, but we will comply with legal deadlines.

5. Annual plans

Full refund within the applicable legal period (e.g., 14 days in EU/TR; 7 days in Brazil). After this period, there is no refund for the remaining period, unless required by law.

8. Intellectual Property and User Content

• 8.1. Editlabs (or its licensors) holds the rights to the Platform, trademarks, and documentation
• 8.2. You retain the rights to your content; by using the Services, you grant the necessary license for technical processing, rendering, and temporary storage, as per the Terms of Use
• 8.3. You declare you have rights to the content you submit and are responsible for obtaining authorizations/licenses from third parties where required

9. Data Protection and Privacy

• 9.1. We process personal data according to the Privacy Policy and applicable laws (including GDPR/LGPD, where relevant)
• 9.2. Relevant sub-processors will be listed and contractually bound to security and confidentiality obligations
• 9.3. Security incidents will be notified within legal deadlines

10. Support

• 10.1. Support on business days, 09:00–18:00 (America/São Paulo), via support@editlabs.ai

11. Liability and Legal Warranties

• 11.1. To the extent permitted by law, our total liability for direct losses related to the Services is limited to the amounts paid in the 12 months prior to the event
• 11.2. Nothing in this Agreement excludes or limits irrevocable consumer rights or liability for willful misconduct or fraud

12. Sanctions, Export, and Compliance

You declare you are not listed on sanctions and commit to using the Services in compliance with applicable export, anti-bribery, and anti-corruption laws.

13. Governing Law and Dispute Resolution

• 13.1. The governing law and venue/arbitration follow the Terms of Use, without prejudice to the mandatory rights of the consumer in your country of residence
• 13.2. Consumers may have access to local complaint mechanisms/consumer defense authorities, under applicable legislation

14. Changes to this Agreement

We may update this Agreement to reflect legal or operational changes; we will publish the new version with an effective date and, where required, reasonable prior notice.

ANNEX I — EU/EEA/UK: Instructions and Model Withdrawal Form

Instructions (summary)

You have the right to withdraw from this contract within 14 days without giving any reason. The withdrawal period expires after 14 days from the day of the conclusion of the contract (services). To exercise the right of withdrawal, you must inform us of your decision by means of a clear statement (by email or via the dashboard).

Effects

We will reimburse all payments received without undue delay, and no later than 14 days from the day on which we are informed of your decision. We will use the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise.

Exception

For digital content not supplied on a tangible medium, if performance has begun with your prior express consent and acknowledgment of losing your right of withdrawal, there is no right of withdrawal.
